- Seller: A registered user who lists property for sale or rent on the platform.
- Buyer: A registered user seeking to purchase or rent property listed on the platform.
3. Registration
To access certain features on the website, users (agents, homeowners, sellers, or buyers) are required to register by providing accurate and complete information. You must:
- Be at least 18 years old.
- Provide valid contact information (email, phone number, etc.).
- Agree to receive communications related to your account and listings.
Failure to provide accurate information may result in suspension or termination of your account.
4. Agent Terms
Agents registering on Developers Point Kenya must adhere to the following:
- License & Certification: All agents must possess a valid real estate license. You may be required to submit documentation proving your certification.
- Representation: Agents are solely responsible for representing their clients in an ethical and professional manner.
- Listings: All listings must be accurate, up-to-date, and legal. Misrepresentation of property information is prohibited.
- Commissions & Fees: Agents are responsible for disclosing any commissions or fees charged to sellers or buyers in accordance with the law.
- Accountability: Agents are solely responsible for the actions and interactions they conduct through the website.
5. Homeowner & Seller Terms
Homeowners and sellers must agree to the following terms:
- Accuracy of Listings: All property information, including price, location, and specifications, must be truthful and current.
- Ownership & Legal Rights: You must own the property you are listing or have legal authority to list the property. Developers Point Kenya reserves the right to request proof of ownership or authority.
- No Duplicate Listings: Avoid posting the same property multiple times. Duplicate listings may be removed.
- Responsibility: You are responsible for managing inquiries, scheduling viewings, and negotiating terms with buyers or renters.
6. Buyer Terms
Buyers using the platform agree to:
- Due Diligence: Conduct their own research and verify all property details before making any commitments.
- Legitimate Intentions: Use the platform solely for the purpose of buying or renting property.
- Accuracy of Information: Provide accurate personal and financial details when engaging with sellers or agents.
7. Payments & Fees
- For Agents: Commission structures between agents and their clients must be clearly stated and agreed upon independently.
- For Buyers/Sellers: Any transaction fees or service charges incurred on the platform will be clearly stated before confirming transactions. Developers Point Kenya does not assume responsibility for transactions outside the platform.
8. Prohibited Activities
Users may not engage in the following:
- Misrepresentation: Providing false or misleading information about properties, pricing, or your credentials.
- Spam & Unsolicited Contact: Sending unsolicited messages or communications to other users.
- Illegal Activities: Engaging in activities that violate any local, state, or national laws, including but not limited to property fraud or money laundering.
9. Intellectual Property
All content on the website, including listings, images, descriptions, and branding, is the intellectual property of Developers Point Kenya or licensed third parties. You may not copy, modify, or distribute any content without prior permission.
10. Privacy & Data Protection
By using the platform, you consent to our Privacy Policy, which governs the collection, use, and protection of your personal information. Your data will not be sold to third parties without your consent.
11. Liability
- Developers Point Kenya acts as a facilitator between buyers, sellers, and agents. We do not guarantee the accuracy of listings or the actions of users.
- We are not liable for any direct or indirect damages resulting from transactions made on the platform, including but not limited to property misrepresentation, non-payment, or fraud.
12. Termination of Account
Developers Point Kenya reserves the right to terminate any user’s account at its discretion for violations of these terms or for any illegal activity on the platform.
13. Changes to Terms
These terms may be updated periodically to reflect changes in policies, regulations, or platform updates. Registered users will be notified of any major changes. Continued use of the platform after changes implies acceptance of the revised terms.
14. Dispute Resolution
Any disputes arising between users or between users and Developers Point Kenya will be resolved through binding arbitration, unless otherwise prohibited by law.
